Skyjade – Terms of Service

1. Introduction

These Terms of Service (hereinafter referred to as “Terms”) set forth the rules for using the Skyjade service (hereinafter referred to as “Service”). By using the Service, the user (hereinafter referred to as “User”) accepts these Terms.

2. Use of the Service

1. The User shall use the Service in compliance with applicable laws and these Terms.
2. The User shall not infringe the rights of third parties or disrupt the intended operation of the Service.
3. The User is responsible for the security of their account and identifiers and shall keep them confidential.

3. Prohibited Activities

It is strictly prohibited to engage in the following activities while using the Service:

• Intentional overloading of systems (e.g., DoS/DDoS, excessive resource usage).
• Spamming or overloading the systems with unsolicited messages, including the use of automated messaging solutions.
• Unauthorized access attempts to Skyjade servers, databases, or other users’ data.
• Distribution of malicious code, viruses, or other content that poses a security risk.
• Any activity that threatens the integrity, security, or availability of the Service.

Note: “Spamming” includes the generation of large volumes of unsolicited, promotional, or disruptive messages, requests, or events within or towards the Service.

4. Consequences of Violations

1. Skyjade may, at its sole discretion, take the following actions in case of a violation:
   • temporarily or permanently suspend access,
   • place the User on the Service’s blocklist,
   • delete the User’s account,
   • initiate legal action and claim damages.
2. The above measures may be applied cumulatively and may be executed without prior notice if required for security or continuity of the Service.

5. Intellectual Property

The interfaces, source code, names, logos, and other elements of the Service are the intellectual property of Skyjade or its licensors. Unauthorized use of these is prohibited.

6. Disclaimer of Liability and Warranties

1. Skyjade strives to ensure continuous and secure operation of the Service. However, to the extent permitted by law, Skyjade disclaims all liability for indirect or consequential damages arising from the use of the Service.
2. Skyjade assumes no liability for damages resulting from User violations, including but not limited to spamming and system overloading.

8. Modifications

Skyjade reserves the right to unilaterally modify these Terms. Users will be notified of modifications via the Service interface or email. Modified Terms take effect upon publication unless otherwise stated.

9. Governing Law and Dispute Resolution

Unless otherwise provided, these Terms are governed by the laws of Hungary. Parties shall attempt to resolve disputes amicably; failing that, the competent Hungarian courts shall have jurisdiction.

10. Final Provisions

1. If any provision of these Terms is found invalid, the remaining provisions shall remain in effect.
2. These Terms constitute the entire agreement between the User and Skyjade regarding the use of the Service.
